Warranty Policy

1. Definitions

In this Warranty Policy, unless the context otherwise requires:

  • Company, we, us, our means 9th Creations Pty Ltd ATF 9th Creations Trust T/A 9th Element.

  • Products means windows, doors, framing systems, glazing units, hardware, and associated components supplied by the Company.

  • Customer means the original purchaser of the Products.

  • Installation means the on‑site fitting of Products into a building.

  • Australian Standards means all applicable standards published by Standards Australia, including but not limited to AS 2047, AS 1288, AS/NZS 2208, AS 1170, and AS 3959 (where applicable).

  • NCC means the National Construction Code of Australia (including Volume One and Two as applicable).

  • ACL means the Australian Consumer Law under Schedule 2 of the Competition and Consumer Act 2010 (Cth).

2. Warranty Overview

The Company warrants that its Products, when:

  • manufactured under controlled production processes,

  • transported and stored correctly,

  • installed in accordance with Company installation guidelines, the NCC, and applicable Australian Standards,

  • and maintained in accordance with Section 9 of this Warranty,

will be free from defects in materials and workmanship for the warranty periods detailed in Section 4.

This Warranty applies in addition to, and does not limit or exclude, any rights or remedies available under Australian Consumer Law.

3. Warranty Provider & Jurisdiction

This Warranty is provided solely by 9th Creations Pty Ltd ATF 9th Creations Trust T/A 9th Element, the Australian importer, distributor, and warranty holder for Products manufactured offshore.

This Warranty is governed by the laws of Australia, and any disputes shall be subject to the jurisdiction of Australian courts.

4. Warranty Periods

Unless otherwise agreed in writing, the following warranty periods apply from the date of delivery.

4.1 Frames & Structural Components

  • Aluminium window and door frames: 7 years

4.2 Insulated Glass Units (IGUs)

  • Seal failure resulting in moisture between panes: 7 years

4.3 Glass

  • Toughened and laminated glass compliance with AS 1288 and AS/NZS 2208 at time of manufacture: 7 years

  • Glass breakage is excluded unless caused by a proven manufacturing defect.

4.4 Hardware

  • Rollers, locks, hinges, handles, operators: 1 years

4.5 Surface Finishes

  • Powder coating and anodised finishes (subject to environmental exposure): 7 years

  • Finishes in marine or high‑corrosion zones may be subject to reduced coverage unless otherwise specified in writing.

5. Standards & Compliance

All Products are designed and manufactured to support compliance with:

  • National Construction Code (NCC) performance requirements

  • AS 2047 – Windows and external glazed doors in buildings

  • AS 1288 – Glass in buildings

  • AS/NZS 2208 – Safety glazing materials

  • AS 1170 – Structural design actions

  • AS 3959 – Construction of buildings in bushfire‑prone areas (where specified)

Final compliance remains dependent on correct specification, installation, and whole‑of‑building design.

6. What This Warranty Covers

This Warranty covers:

  • Manufacturing defects in materials or workmanship

  • Structural integrity of frames under normal residential or commercial use

  • IGU seal failure causing internal condensation

  • Surface finish failure due to manufacturing defects

Where a valid claim is approved, the Company will, at its discretion:

  • Repair the defective Product, or

  • Replace the Product or defective component, or

  • Provide an appropriate refund for the defective Product only

7. Exclusions

This Warranty does not apply to defects or failures arising from:

  • Incorrect or non‑compliant installation

  • Installation not in accordance with Company instructions, NCC, or Australian Standards

  • Building movement, subsidence, or structural settlement

  • Use of Products outside their intended purpose

  • Failure to undertake required maintenance

  • Exposure to abnormal or corrosive environments without written approval

  • Damage caused by third parties, site handling, or subsequent trades

  • Normal wear and tear

  • Cosmetic issues identified after installation and practical completion

  • Glass breakage, scratching, or impact damage

  • Colour variation or minor changes in finish appearance over time

8. Installation Requirements

To maintain warranty validity:

  • Products must be installed by licensed and appropriately qualified tradespeople

  • Installation must comply with:

    • Company installation manuals

    • NCC requirements

    • All relevant Australian Standards

  • Products must be inspected for damage or defects prior to installation

  • Any visible defects must be reported before installation

9. Maintenance Obligations

Proper maintenance is essential to warranty coverage.

Customers must:

  • Clean frames, glass, and hardware regularly using non‑abrasive cleaners

  • Lubricate moving hardware components as specified by the Company

  • Keep drainage and weep holes clear

  • Increase cleaning frequency in coastal, marine, or industrial environments

Failure to comply with maintenance requirements may void this Warranty.

10. Warranty Claims Procedure

To make a claim, the Customer must:

  1. Submit a written warranty claim to the Company

  2. Provide:

    • Proof of purchase

    • Installation details

    • Photographic evidence

    • Description of the issue

  3. Allow reasonable access for inspection if required

The Company reserves the right to inspect Products prior to approving any claim.

11. Limitation of Liability

To the maximum extent permitted by law:

  • This Warranty is limited to the repair, replacement, or refund of defective Products only

  • Labour, access costs, removal, reinstallation, scaffolding, and consequential losses are excluded unless required under the ACL

  • Replacement Products may not be identical but will be functionally equivalent

12. Australian Consumer Law Notice

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

This Warranty operates in addition to your rights under the Australian Consumer Law.

13. Transferability

This Warranty applies only to the original purchaser and is not transferable unless expressly agreed in writing.

14. Sustainability Statement

The Company is committed to responsible manufacturing practices, product durability, and long‑term environmental performance. Warranty coverage supports Products designed to contribute to efficient, compliant, and sustainable building outcomes when correctly specified and maintained.
